Catastrophic/Brain Injuries

Catastrophic injuries are defined as injuries that cause suffering and life-altering losses.

Ontario accident benefits regulations mandate that lawyers move ahead with these cases on a different path, extending the parameters and limits for compensation and benefits that are available to these individuals.

These include but are not limited to the following:
            (a) paraplegia or quadriplegia;
            (b) amputation or other injury causing the permanent loss of function of both arms;
            (c) amputation or other impairment causing the permanent loss of function of both an arm and a leg;
            (d) total loss of vision in both eyes;
            (e) brain impairment that, in respect of an accident, results in,
                        (i) a score of nine or less on the Glasgow Coma Scale; or
                        (ii) a score of two (vegetative) or three (severe disability) on the Glasgow
Outcome Scale;
            (f) in accordance with the A.M.A. Guide, any impairment or combination of impairments that results in a fifty-five percent or more impairment of the whole person;
            (g) in accordance with the A.M.A. Guide, any injury that results in a class four (marked impairment) or class five (extreme impairment) due to mental or behavioural disorder
