Medical/Dental Malpractice

Doctors enjoy a well deserved high level of respect from the public. We turn to them for life and death services. Medical services in Ontario are unsurpassed. Still, things can go wrong.

We often hear the term "malpractice". What does this mean? In short, malpractice means that the treatment which the patient has received from the doctor or other professional has fallen below the reasonable standard of care that one would expect from that person considering his or her training qualifications and circumstances on which the professional is practicing. The standard of care expected of a specialist practicing in a large city hospital, for example, would be considerably higher than the standard expected of a general practitioner practicing in a rural community.

In determining whether or not there has been malpractice, very often an expert opinion is required from another person practicing in the same field as to whether or not the required standard has been met.
