Dog Bites

Most of us are dog lovers. It is hard to imagine our beloved pet causing serious injury to someone. Yet every year, thousands of people are injured as a result of dog bites and attacks. Some of these can be very serious and cause years of physical pain as well as serious disfigurement and scarring. In Ontario, the Dog Owners Liability Act makes the owner of a dog almost absolutely liable for any damages caused by a dog attack or bite. If the person who owns the dog is a homeowner, homeowners insurance will usually cover the cost of any claim made against the dog owner.

Singer, Kwinter has represented thousands of victims of dog attacks, ensuring that the insurance company of the dog owner pays proper compensation for the pain, suffering, scarring and out-of-pocket expenses suffered by the victim.

One of the leading cases in Ontario involving a dog attack was Wong v. Arnold. Mr. Wong had gone to his paper boy's home to see why his paper had not been delivered. Before he had a chance to climb the stairs, he was attacked by the boy's German Sheppard. The injuries suffered by Mr. Wong kept him off work for a year. The insurance company refused to pay the claim. Mr. Wong retained Alf Kwinter of the firm of Singer, Kwinter. He was successful at trial and the insurance company appealed to the Ontario Court of Appeal. The Appeal was unanimously dismissed with costs.

Anyone bitten or attacked by a dog who sustains injury should immediately:

    (a)  seek medical attention;
(b)  ensure that the dog has had all necessary shots by speaking to the dog owner;
(c)  obtain the name and address of the owner of the dog;
(d)  immediately take photographs of the injured area;
(e)  keep all bills, receipts and other evidence of expenses arising from the attack.
